			<description><![CDATA[ Mitch, I think that the phrase &quot;changed the law&quot; is misleading here. The presiding judge has the authority to change fine amounts on offenses, as long as those changes do not exceed the statutory maximum fine for the offense. He is not making new law by changing the amount of the fine, he's just adding additional punishment. I don't think the judge changed the law here, he just put more pressure on the Officers to do a part of HIS JOB! That way, come election time, he doesn't have... ]]></description>

Did you see the CBS evening news last night?  There is a lot over political warring right now over the presidential appointment of a supreme justice.  The story basically was showing how religeous groups are getting behind democrats to filibuster the republican backed appointment.  <br><br>
It is true though that judges are basically overstepping their bounds.  Gay marriage, separation of state and church, privacy rights, and gun control are the subjects most notably thrown... ]]></description>

			<description><![CDATA[ Anyone clocked at &quot;triple digits&quot; should be facing more than a fine, maybe immediate vehicle impoundment, maybe a free trip to city hall.  Excessive speeders should be cracked down on.<br>
The crotch rocket riders start dropping dead here every year when the riding season starts.  Most of these guys have little or no riding experience, they go plunk go their $69 down and sign up for $69 a month and hit the road.  <br>

			<description><![CDATA[ I agree that giving the officer that much discretion is a recipe for unfair treatment. Bet that sounds odd coming from a Trooper! The Judge is the one who should make the fine determination, not the Officer. That's why he makes twice the money that I do!<br><br>

While the Tail is a technical road, it's not difficult to ride it safely.  Last year a couple of squids blew past me, but I also got caught behind a RV and only saw two trucks.  <br><br>
In a couple of 300 degree switchbacks I was able to hit a max speed of 25 mph, 10 over the limit.  With the exception of a few spectacular turns, most are mild and there's a lot of gentle sweeping turns in the middle.<br><br>

			<description><![CDATA[ Know what you mean, Andy.  Matter of fact I have all but decided to fore-go riding the Dragon's Tail while at the Hoot this year.  Too many scary clips on the thread on the Forum here as well as other web sites highlighting the road makes me feel pretty certain I don't want to ride that stretch of road at all and especially when the roads are extra crowded because of a national rally going on.  It isn't just the squids on sportbikes but some of the semi rigs antics on that stretch of pavement... ]]></description>

I wasn't suggesting that there was a check and balance system with judges.  Working at a law firm in Ohio with 88 counties and about 150 courts; each judge thinks they're on top of the mountain and pass down moronic rulings that make you scratch your head and wonder.<br><br>

I understand why they want to raise to fine but putting the punishment or penalty phase of a civil or criminal activitiy in the hands of the officer is kind of putting the cart in front of the horse.  They've short circuited the check and balance system.<br><br>
The way I thought it was supposed to work:<br><br>
- An officer see's you violating a law and cites you; making notations about speed and conditions; you know, as Jack Webb would say &quot;Just the facts&quot;.<br><br>
