Posts: 7800 04/08/08 3:09 PM	Tags : None I don't know the end to this story, but it's coming. I finally was prepared to order a set of Cobra Floorboards for my T. I searched ebay and found a pair at $209 that I was pleased with so I 'bid' on the Buy It Now price and of course I won. Now the story gets better. I go to pay for this and I am directed to a PayPal site. PayPal wants me to join before I can use my credit card. So I join. Now PayPal wants me to confirm my account and tells me that I have to wait for the charge to hit my credit card, then take this number I'm suppose to find and go back to PayPal and then put the number in and (deep breathe) my account will be confirmed. Then PayPal will process the credit card for the charge and I can get my Floorboards. Bull $hit. After doing all of this I don't know if I get the floorboards or not. So I call the company selling the floorboards and they tell me that they have the order. Well that is more than ebay or PayPal told me. So that much is good. Then I call PayPal and some non-native speaking man tries to explain to me how things work and I decided it would make more sense if I ran outside into the path of a schoolbus. I hear a lot of gobble de goop and decided I shouldn't get excited that everything will work out in the end. Meantime I have nothing, no floorboards, no charge to my credit card, ebay telling me I am under contract to purchase this item, and a dealer who tells me his operation is so small that he relies on ebay and PayPal to do his business for him. Okay so I ranting and raving again. I've got to calm down. Did I learn anything yet from all of this. Not yet. My instincts tell me I was stupid for going this route. You have a lot more security after all the confirmation stuff! One suggestion...............Change your Pay=Pal password every once in a while. Oh-Yea- You will love the floor boards! HSATF 1st Officer Posts: 981 04/08/08 9:21 PM	Alepel That is how paypal verifies that you are who you say you are, you should be the only one with access to your account info. I tied a debit card to my PP account, they made 2 deposits of small change into my bank acct. that backs the debit card, I had to tell paypal what those deposits were to verify that I was the legal owner of the bank acct. This bank acct. carries a one dollar balance until I make a purchase, then I transfer the transaction amount into the acct. for paypal to draw from. Doing it this way is safer because if some lowlife hacks my PP account there is nothing for him to take. It's a pain to setup but works well once it is. HSATF 1st Officer Posts: 3702 04/08/08 10:35 PM	I stopped using PayPal when they pulled $1700 from my sons bank account and held it for 9 months. He sold an ATV engine to some low life in CA and he claimed to not have received it. UPS got involved and produced a copy of the signed drop off document where he had indeed received the engine and signed for it. Pay Pal was still not satisfied that the low life had received the engine and held the $1700 in escrow until 9 months had passed. I got involved and threatened legal action if they did not release the money within 10 days, so Pay pal decides to put an indefinite lock on both our accounts since we are related and live at the same address. That was over 2 years ago and they still have my money tied up. No more Pay Pal for me even if they did unlock my account. The most aggravating part about it is that I can't close the account either. They tell me I can put money in but can't take it out. Duh!! OK, I've done my rant on this for now. I really had mixed feelings about going the PayPal route because Lou (hombldr) was vehement about my using them. Fortunately my issues are not with the dealer only with PayPal. Posts: 1904 04/09/08 10:12 AM	Stan, Kind of a round about way, but this is what I would do... - Get an attorney in case you need to follow the backup plan. - File a law suit in the jurisdiction that would cover the transaction, probably the location of the item that was for sale or the shipping point. - Follow the suit until you obtain a judgment. In a small claims court, this should be 60-90 days. I doubt Paypal will take your suit seriously, and will probably not even send an attorney to answer/counterclaim. Without an answer or counterclaim, you should be awarded a 'default judgment'. - If Paypal answers/counterclaims, see if the attorney will turn your case in to class action case. You won't see any money but you can take satisfaction knowing Paypal will have to pay hundreds of thousands of dollars to defend their position. - Want to make it even more fun, have the attorney throw around the words "Federal Rules of Civil Procedure". These five words will usually give an IT manager a heart attack. It's basically electronic discovery of facts where you demand an indexed copy of all their business and email records to see if they are violating any local, state and federal laws. - To collect on the judgment, go back to court and file a document called 'A garnishment of other than wages'. In the collection industry, we use this to get money from peoples bank accounts, A/R money due,... basically any funds other than wages. - The court will file an order against Paypal to freeze some funds and order a payment of the judgment amount. At this point Paypal has to answer to the court or be in contempt of court. Can you say 'Boy, you're in a heap of trouble'. - I would imagine Paypal will voluntarily release the funds to avoid the hassle and legal expense of defending their position. Even if this does not work out, at least you will be able to mess with them enough to get some entertainment value for the funds they are withholding. Andy

Posts: 1904 04/09/08 12:09 PM	Al, The key is to find an attorney stupid and greedy enough to take it on a contingency fee basis. Fortunately (or unfortunately) there are too many stupid and greedy attorneys out there. And the stupidest and greediest become out lawmakers. That's a different topic. On a contingency fee basis, you would have to pay court costs/filing fees and the attorney agrees to take his/her fees from the judgment award, and only if they can collect the money due.

Posts: 7800 04/11/08 7:22 AM	Thanks for all the great advice from all of you. To update this saga, I did receive the small charge to my credit card and the number I needed to confirm the PayPal link. Then PayPal told me I was legitimate. Now it seems that the PayPal thing is all squared away, but I still have no idea if they are now going to put through my charge that started this all. The thought occured to me to put the charge through again because PayPal balked about it the first time. What PayPal has failed to do is to let me know that the initial charge will now go through or if I have to re-submit the charge now that PayPal is set up. I guess the smart thing to do is to call the ebay dealer and ask him if PayPal/ebay have given him the release to ship the product. I'm really anxious to get the new Cobra floorboards and get them mounted in time for my spring clean-up of the T. alepel "Ride with the Spirit always, and in all ways"....hombldr
