You probably will not find an EPA sticker or marking on the Jardines. As for the ticketing, I can think of a few random thoughts:

I've had V&H, Jardines and stock pipes on my T. The V&H would probably fail the test but I think the Jardines would pass.

I don't know how they would test the sound level. A Jardine at an idle is very quiet. Would they make you rev up to a certain rpm? Without a tach, how would you know?

I would think you could challenge their subjective decision, make them bring equipment to back up their claim. It seems to me, kind of like booking a DUI... the officer witnesses an appearant offense, then conducts a field test with calibrated equipment. Without concrete proof, I doubt a claim would stand in court... I mean, can an officer say "Well, I thought he was kinda drunk but I never did a field check" and expect a DUI conviction to stand up in court? I think the same would apply here.

Consider passing the restriction on to the AMA. There were many 'silly' laws that were tossed out or dropped after the AMA got involved. One that comes to mind was a manditory organ-donor endorsement that was going to be implied for all motorcycle riders in Arizona, because in the law makers eyes, all riders have a death-wish. When the AMA got involved, the bill was tossed out.

Personally, I would like to see straight pipes/loud pipes outlawed. I live on a back road and am getting tired of being awoke by a drunk gunning his straight pipe bike at 3am in the morning. These are the guys who are ruining it for everybody.
